Gopher Epidemic Frustrates Homeowners: MyFoxPHOENIX.com
If you're buying a home, don't you expect to have the seller be honest and disclose all problems with the property? When you get a home inspection, don't you expect all problems to be stated by that inspector?
Unfortunately, most states do not require gophers to be part of any inspection, only termites. A gopher is much more destructive than a termite; you can replace wood. How do you replace the foundation underneath a home or swimming pool?
Too many banks are selling homes "AS IS" which means that regardless of what is wrong with the home, they are without any liability or responsibility. This is wrong! If they are going to take these properties from homeowners, then they better maintain them.
Many times, crews will be sent in to "clean up" a property prior to purchase, others like foreclosed homes, are left to fall into disarray, where weeds grow so high you can't see over them. When crews "clean up" they are instructed to knock down gopher mounds, bring in new rock and landscaping, so the potential buyers see nothing wrong. After the sale goes through and the new homeowner is unpacking, they begin to see new dirt mounds throughout their property. If they've started landscaping, it will all be destroyed in days. The property above was overrun with hundreds of gophers, tunneling through from all directions.
If you live next to one of these vacant homes, contact the company on the sign and if they do nothing, send a demand letter. You do have legal rights to have your property protected against nuisance properties and the problems of gophers spilling into your property.
If they do nothing and your property is damaged, there are plenty of attorneys who will gladly take your case and file on your behalf. You first have to take care of your problem, so you can show a judge that you did your part, while someone else did nothing, leaving you to pay for it all.
It's time that everyone is responsible for their properties and this includes those banks who are allowing homes to sit vacant for months and years. Allowing gophers to breed out of control, damaging everything in their path, is irresponsible and they need to be held accountable.
If you have purchased a home and the gopher situation was not disclosed, you also have legal rights regarding this purchase. Disclosure means just that. You do NOT want to be a victim like many of my customers and their neighbors.
