Since we have returned to Arizona and have learned that the AZ Structural Pest Control Commission is deliberately discriminating against us, we are going to fight them all the way! We have the right to have a business and earn an honest living. This agency is all about control, trampling on our rights and ignoring laws that are in place to protect everyone. When this agency has allowed other businesses like ours, who do not use any chemicals, poisons, baits or pesticides, yet still demand that we get licensed with them, then there is something seriously wrong. Top that off with a big dose of non-compliance of Title II of the ADA and Amendments. Why this state agency 'thinks' it can force me not to publish my book, makes no sense! This book is a comedy. We have never used any pesticides, poisons, baits or chemicals, absolutely nothing that comes under their jurisdiction. They keep tossing 'invented' claims at us, all wasted effort. Arizona does recognize the Grandfather Clause and we were in business years before they decided to try and push us out. These people and their inspectors have no business trying to regulate trappers, especially when they have absolutely no clue about what we do! Their inspector looks real ignorant in historical documents, with his descriptions. The list we have is long.
This agency has also invented facts that never happened. They never followed Due Process and never gave us any opportunity to be heard or access to any hearing. Their claims to any dates and communications with us can be easily proven and we can't wait until this information is published. Now they are stating in their minutes that they no longer have to give Due Process! Isn't Arizona still part of America?
It is time that Arizona residents know exactly what this state agency is up to. Thanks to this agency and those in control, the prices for pest control are insane! Are you aware that for every termite inspection or treatment, these companies are forced to pay back to the commission $8.00? When you start adding up the numbers, this commission in taxing Arizona business owners millions each year! This commission has now attacked Landscaping, Aquatics and others. While the EPA states that products sold to the public are open for usage, this commission is fining companies $1,000.00 for applying RoundUp! This commission never gave sufficient notices to the public, yet they have continued to hand out stiff fines and run small and minority owned companies out of business. Like us, this commission is over-stepping their boundaries with these other trades. What are they saying to the Landscapers and those who clean ponds and aquariums? Is it something like, "We're going to take away your money and ability to work and give it to our people, have a nice day!" These people are being followed, harassed and fined, all in the name of public safety. What they're doing is not looking out for the best interest of the citizens of Arizona. It's all about the money from the fines. The same fines that small businesses and minorities are getting, when the largest companies get minimal or no fines for serious spills or other offenses. It's time for Arizonans take a stand against out-of-control self-serving agencies. We are told that the SPCC is the richest agency in Arizona, this money belongs to those in the industry, not those who sit in the office and aren't capable of carrying out simple tasks.
